Article 1: Agreement and Term

ARTICLE 1:  AGREEMENT AND TERM

 

1.1       Parties

 

This Agreement between the Governing Board of the Yuba City Unified School District (hereinafter “District”) and the exclusive representative, Yuba City Teachers Association (hereinafter “Association” or “YCTA”), has been reached through “meeting and negotiating” as defined by Section 3540.1(h) of the Government Code.

 

1.2       Term

 

The parties agree to a three-year contract effective upon ratification and extending to and including June 30, 2016.

 

1.3       Reopeners

 

1.3.1       After completion of the District’s Local Control Accountability Plan (LCAP) for 2014/2015, but not later than August 1, 2014, the parties shall reopen negotiations for the purpose of negotiating any changes in working conditions and compensation needed to implement the strategies defined in the LCAP.

 

1.3.2       After completion of the District’s LCAP for 2015/2016, but not later than August 1, 2015, the parties shall reopen negotiations for the purpose of negotiating any changes in working conditions and compensation needed to implement the strategies defined in the LCAP.

 

1.3.3       In the development of the LCAP, set forth in 1.3.1 and 1.3.2, the parties have reached the following agreements:

 

●       There is a need to collaborate with YCTA, as one of the State-identified stake-holders on development of an LCAP that emphasizes student achievement, professional preparation, attraction and retention of high quality professional staff members, and competitive compensation for employees.

 

●       Strategies that evolve from the LCAP may be within the scope of bargaining and negotiations will occur prior to implementation of those issues and/or over the impact of those issues.

 

1.3.4       Contract reopener negotiations for 2015/2016 shall be limited to compensation (Articles 11 and 12 and Appendices A-C), benefits (Article 13 and Appendix D) and two (2) additional articles per each party.

 

1.3.5       Negotiations will begin within thirty (30) regular student attendance days of the date that either party submits a proposal for a successor contract to the other.  Except upon mutual consent, negotiations shall not be required during the summer recess.
